Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AuctioNin mobile application and website (collectively, the "Platform"), operated by AuctioNin ("we", "us", or "our"), registered in the State of Kuwait. By downloading, registering, or using AuctioNin, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use AuctioNin. By using the Platform, you confirm you are of legal age and have the authority to enter into binding agreements under applicable law.

2. Account Registration

You must create an account to use AuctioNin's core features. You agree to provide accurate information, keep your credentials secure, and notify us immediately of any unauthorised use. You are responsible for all activity under your account.

3. Buyer Terms

• All bids placed on AuctioNin are binding. A winning bid constitutes a legal purchase obligation.
• Payment must be completed within the time specified after winning. Failure to pay may result in account suspension.
• A payment hold is placed on your card at the time of bidding. The hold is released if you do not win.
• Buyers are protected by AuctioNin's Buyer Guarantee. Disputes must be raised within 48 hours of delivery or expected delivery date.
• AuctioNin reserves the right to refund and cancel any transaction found to be fraudulent or in breach of these Terms.

4. Seller Terms

• Sellers must complete KYC identity verification before listing items or going live.
• Sellers are responsible for the accuracy of all item descriptions, photos, and condition disclosures.
• Sellers must fulfil orders within the timeframe specified in their listing or agreed with the buyer.
• AuctioNin deducts applicable platform fees at the time of transaction. The remaining amount is credited to the seller's wallet immediately.
• Seller wallet withdrawals to bank accounts are held for 24 hours for dispute protection. Wallet balances are available immediately for in-app use.
• Sellers may not list prohibited items including counterfeit goods, weapons, controlled substances, or items prohibited under Kuwaiti law.
• Subscription plans are billed monthly or annually. Cancellation stops future billing; no refunds for the current billing period.

5. Prohibited Conduct

Users may not: manipulate bids or pricing; create multiple accounts; impersonate others; post false or misleading information; disrupt Platform operations; or use AuctioNin for any purpose that violates applicable law.

6. Live Sessions & Content

Sellers who broadcast live sessions are responsible for all content shown. Content must comply with Kuwaiti law and community standards. AuctioNin reserves the right to terminate any live session that violates these Terms without notice.

7. Fees & Payments

Platform fees are disclosed to registered sellers inside the app. Payments are processed via our payment partners including Stripe and MyFatoorah. AuctioNin is not responsible for payment processing issues caused by third-party providers.

8. Intellectual Property

All Platform content, branding, and technology are the property of AuctioNin. User-generated content remains the property of the user, but you grant AuctioNin a licence to display and promote such content on the Platform.

9. Limitation of Liability

AuctioNin is a marketplace platform facilitating transactions between buyers and sellers. We are not the seller of record for any item. To the maximum extent permitted by law, AuctioNin's liability shall not exceed the total fees paid by the user in the preceding 12 months.

10. Termination

AuctioNin may suspend or terminate your account at any time for breach of these Terms or fraudulent activity. You may delete your account at any time from within the app settings.

11. Governing Law

These Terms are governed by the laws of the State of Kuwait. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via push notification or email. Continued use constitutes acceptance of the updated Terms.
